Synchroteam Inc. ("Synchroteam", "we", "our" or "us"), as Data controller, respects and is committed to protecting your privacy. That is why we have adopted this Privacy Policy. This Privacy Policy provides an overview of what information we may collect from you, and how we may use it. We pledge that we will take reasonable steps to ensure that your personal information will only be used in ways that are in compliance with this Privacy Policy and with the General Data Protection Regulation (GDPR) of 27 April 2016. Synchroteam will only use your Personal Data for the purposes described in this Privacy Policy.

This Privacy Policy is only in effect for any collective non‑user-specific information and personal information collected on or through websites of Synchroteam and its affiliates, as well as any online features, services and/or programs offered by Synchroteam on our website, www.synchroteam.com (collectively, the "Site"), the Synchroteam mobile application (the "App"), and through our on-demand support platform, tools and services offered on the Site (the "Service").

When you register for a Synchroteam Mobile Collaboration Solution Account (an "Account"), you can be certain that we have implemented comprehensive security practices to ensure that only you and those people you provide authorized access to can see your account.

INFORMATION YOU PROVIDE

When you register for the Service, we ask for information such as your name, company name and address, e-mail address, credit or debit card information, or other payment details. If you sign up for the 14-day free trial account, you are not required to enter your payment information until you decide to continue with a paid plan. You will find below all the categories of Personal Data that are collected by Synchroteam when you fill forms on the Site or when you communicate Data to Synchroteam, for example by email or by other means of communication made available on this website:

These Personal Data are confidential and can only be used or transmitted according to the conditions defined in this Privacy Policy. These data can only be processed for the purposes for which they have been collected. All Personal Data requested are mandatory to set up the requested Service or for the processing of your requests. If you do not provide these Data, Synchroteam will not be able to set up the service or answer your requests. Synchroteam collect and process your Personal data for the following purposes:

USAGE INFORMATION AND COOKIES

What is a Cookie?

A Cookie contains information about the user’s browsing on the website visited. A cookie is a text file recorded in a specific space on the hard disk of the user’s terminal (computer, tablet, smartphone...), when the user consults a website. A unique identifier is attached to the cookie which is transmitted by the server of the website to the browser used by the user. This unique identifier allows the website to identify the user's terminal where the cookie is stored. This identification will only be allowed during the retention period of the cookie. The internet browser manages cookies in the user’s terminal because the browser receives the order from the server to record cookies. Therefore, the browser will record or control cookies according to the user’s preferences. Cookies enable websites to function or allow them to be more efficient, the user’s browsing will be facilitated. Cookies may also provide information to website owners such as statistics or audience measurements.

How and why Synchroteam uses cookies?

Synchroteam may obtain non-individualized, generic information about you when you use the Site and/or the App. This may include your IP address, Unique Device Identifier ("UDI") and arrival time. The UDI reveals nothing personal about the user other than the UDI from which the user has accessed the Site. We may use this information to examine our traffic in the aggregate, but do not collect and evaluate this information for individuals. For instance, we collect information on the number of visits on our Site, the number of pages consulted, the experience of the user on the Site, the contents consulted, the time you spent on the Site, the browser you used, etc. Thanks to these statistics, Synchroteam will be able to improve the usability and the functioning of the Site and adapt its Site to the various terminal that may be used by users (computer, tablet, smartphone, etc.). To measure interactions on its Site, Synchroteam uses Google Analystics’ service which allows Synchroteam to obtain statistical data.

When you visit the Site or use the App or Service, we use session "cookies" – a piece of information stored on your computer – to allow the Site, App or Service to uniquely identify your browser while you are logged in and to enable Synchroteam to process your online transactions. Session cookies also help us confirm your identity and are required in order to use the Service. Synchroteam uses persistent cookies that only Synchroteam can read and use, to identify you as a Synchroteam customer and make it easier for you to log in to the Service. Users who disable their web browsers' ability to accept cookies will be able to browse our Site, but will not be able to access or take advantage of the Service.
The Site may also contain electronic images known as Web Beacons (sometimes referred to as "clear gifs"). Web Beacons collect only limited information that includes a cookie number, time and date of a page view, and a description of the page on which the Web Beacon resides. These Web Beacons do not carry any personally identifiable information and are only used to track usage of the Site and activities associated with the Site.

When you express your preferences regarding cookies for one device, you should do the same with the other devices that you use to go on Internet. INFORMATION SHARING

Except as described in this Privacy Policy, Synchroteam will not give, sell, rent, or loan any identifiable personal information to any third party. We may disclose such information to respond to subpoenas, court orders, or other legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law. Synchroteam may also provide non-personal, summary or group statistics about our customers, sales, traffic patterns, and related Site or App information to reputable third-party vendors, but these statistics will include no personally identifying information about you.

Synchroteam uses a third-party intermediary to manage credit card and debit card processing, and may partner with other service providers if you choose to make purchases using PayPal, Google Wallet or Apple Pay. This intermediary is not permitted to store, retain, or use your billing information except for the sole purpose of payment processing on Synchroteam's behalf and as permitted by their respective privacy policies.

Synchroteam may also transmit or share your personal information with its third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and other technology and services required to operate and maintain the Service, which may require that your personal information be transferred from your current location to the offices and servers of Synchroteam and the authorized third parties referred to here. Although Synchroteam owns the software, code, databases and all rights to the App, you retain all rights to your data.

Synchroteam will also transmit Personal Data to its subsidiary.

The Site may also link to other websites and contain advertisements of third parties. We are not and cannot be responsible for the privacy policies of those websites of third parties or for how they treat information (including, but not limited, to personally identifiable information) about their users.

We also reserve the right to transfer your information in connection with the sale or other disposition of all or part of our business and/or assets, as further set forth in the "Business Transactions" section.

PROTECTION OF INFORMATION

Synchroteam maintains reasonable security measures to protect your information from loss, destruction, misuse, unauthorized access or disclosure. These technologies help ensure that your data is safe, secure, and only available to you and to those you provide authorized access. However, we do not and cannot guarantee or warrant that any information transmitted through the Internet is secure, or that such transmissions are free from delay, interruption, interception, or error.

MEMBER ACCOUNT, PASSWORD AND SECURITY

For certain features available through the Site and the App, we may require the use of encryption technologies provided for your protection and/or your use of a UserID and password after setting up an Account. We use reasonable precautions to protect the privacy of your UserID, password and Account information by utilizing an SSL connection. Accordingly, your UserID, password and Account information are encrypted using an SSL connection and are not expected to be read in an intelligible form as they travel to the Site. You, however, are ultimately responsible for protecting your UserID, password and Account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies. You agree to: (a) immediately notify Synchroteam of any unauthorized use of your UserID, password and/or Account, and/or any other breach of security, and (b) ensure that you log out of your Account at the end of each session.

The Site and App are designed to protect the privacy of your name, address, e-mail and any other information you provide us. Synchroteam is committed to data security with respect to information collected on our Site or through our App. It is our practice to contact users if a problem should arise with your purchase of the Service or if we need to send you a normal business communication.

INFORMATION COLLECTED FROM CHILDREN

The Site, Service, and App are meant for adults. We do not collect personal information from any person that we know to be under the age of thirteen (13) without permission from a parent or guardian. Specifically, the Site, Service, and App are not intended or designed to attract children under the age of thirteen (13). You affirm that you are more than eighteen (18) years of age, or an emancipated minor, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy.

YOUR RIGHTS

In accordance with the General Data Protection Regulation (GDPR) you have, at any time:

  • A right to access your personal information collected through the website in accordance with this Pivacy Policy;
  • A right to rectify Personal data that are inaccurate, not up to date, incomplete or deleted;
  • A right to erase your Personal Data;
  • A right to request the limitation of the processing of your personal data;
  • A right to request the portability of your personal data;
  • A right to object to the processing of your personal data.

When you download the App, you may be able to manage how your mobile device shares certain information with us by adjusting your mobile device's privacy or security settings. In particular, you may elect whether to share location information with our App to access the mobile App's location based services.

TRANSFERS EUROPEAN UNION

Because the Site can be accessed around the world, the information that we collect may be made available to our affiliates, subsidiaries and clients worldwide. For those users visiting us from the European Union, please note that Synchroteam may transfer your personally identifiable data outside the European Union for use for any of the purposes described above. By using the Site and providing Synchroteam with your personal data, you consent to such transfer of your personal data.

Synchroteam will transmit Personal Data to it subsidiary located in the United Sates. There is a partial adequacy decision of the European Commission for data transfers to the United States under the Privacy Shield. As Synchroteam's subsidiary does not adhere to the Privacy Shield, data transfers are covered by standard contractual clauses issued by the European Commission and concluded between Synchroteam and its subsidiary.

Synchroteam may also transfer data to the United States when it discloses data to providers of services in connection with the Site. These providers adhere to the Privacy Shield and therefore fall within the scope of the European Commission's adequacy decision.

Personal data collected by SYNCHROTEAM through this Site for:

  • The provision of the Solution, the creation of a customer account and access to the service will be retained for[XXX];

The Site may contain links to various websites. Synchroteam is not and cannot be responsible for the privacy practices or the content of any of those websites. Other than under agreements with certain reputable organizations and companies, and except for third party service providers whose services you voluntarily elect to utilize, we do not share any of the personal information that you provide to us with any of the websites to which the Site links, although we may share aggregate, non-personally identifiable data with those other websites. Please check with those websites in order to determine their privacy policies and your rights under them.

GOVERNING LAW

This Privacy Policy will be governed by the laws of the State of Florida and the United States of America without regard to the principles of conflicts of law. By using or accessing the Site or the App or using the Service, you agree that any action at law or in equity arising out of or relating to your use of the Site, the App, the Service or this Privacy Policy will be filed only in the state or federal courts sitting in Miami-Dade County, Florida, and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.

CHANGES TO PRIVACY POLICY

Synchroteam may update this Privacy Policy from time to time. You can review the most current version of this Privacy Policy at any time at http://www.synchroteam.com/privacy. Your continued use of the Site, Service and/or App constitutes your agreement to be bound by such changes to the Privacy Policy. Your only remedy, if you do not accept the terms of this Privacy Policy, is to discontinue use of the Site, Service and App.

BUSINESS TRANSACTIONS

Synchroteam may assign or transfer this Privacy Policy, and your Account and related information and data, to any person or entity that acquires or is merged with Synchroteam. We cannot make any representations regarding the use or transfer of your information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership or an assignment for the benefit of creditors, and you expressly agree and consent to the use and/or transfer of your information in connection with a sale or transfer of some or all of our assets in any of the situations described above.
